This disclosure practice reflects the FTC’s “clear and conspicuous” standard as described in the FTC’s “Disclosures 101 for Social Media Influencers” (November 2019) and the revised 16 CFR Part 255 (effective June 2023).

The Federal Trade Commission’s Endorsement Guides, codified at 16 CFR Part 255 and substantially revised effective June 2023, require that any person who endorses a product or service — including through a blog post, buying guide, review, social media post, or other digital content — and who has a “material connection” to the brand being endorsed must clearly and conspicuously disclose that connection before the endorsement.

The June 2023 revision expanded the definition of covered endorsements to include:

• Reviews and ratings posted on third-party platforms
• Social media posts, including stories, reels, and short-form video
• Consumer-generated content seeded by a brand
• Fake reviews and undisclosed AI-generated content

AirFryerFinder.com applies these disclosure standards across all content formats as described below. Civil penalties for violations of the FTC Act §5 (deceptive practices) can reach $53,088 per violation under current FTC penalty schedules.

Per FTC guidance, a disclosure is “clear and conspicuous” only when it:

• Is unavoidable — not hidden in a footnote, terms page, or “about” section only
• Appears before the consumer encounters the endorsement — not after
• Is in a font size and color that contrast with the background and match surrounding body text in readability
• Is not obscured by other content, requires no scrolling to find, and is not placed only at the end of a long post
• Uses plain language understandable to the average consumer — not legal jargon

AirFryerFinder.com places its in-post disclosure at the very top of every article containing affiliate links, styled in a clearly visible colored banner. This placement satisfies the FTC’s “clear and conspicuous” standard. A stand-alone disclosure page is not sufficient on its own and is not offered as a substitute for per-post disclosure.

Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and consistent with Google AdSense Publisher Policy requirements, AirFryerFinder.com provides visitors with the ability to:

• Accept all cookies (including advertising and analytics cookies)
• Reject non-essential cookies while permitting strictly necessary cookies only
• Manage granular cookie preferences by category
• Withdraw previously given consent at any time via the “Cookie Settings” link in the site footer
• Exercise the CCPA “Do Not Sell or Share My Personal Information” right via the cookie consent tool or by enabling the Global Privacy Control (GPC) signal in their browser

Consent records are stored by the CMP and retained for the period required to demonstrate compliance. Advertising cookies are not activated before consent is obtained from visitors in jurisdictions where consent is legally required. Google AdSense is configured to serve non-personalized ads to visitors who decline advertising cookies.

Under 16 CFR §255.1, the FTC’s revised Endorsement Guides apply to individual endorsers, not only to the publishing entity.
